FINLEADGEN LLC, doing business as PomeloHost, respects intellectual property rights and responds to notices of alleged copyright infringement under the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.
1. Designated agent
Send copyright notices to our designated agent:
Andrey Sharov, FINLEADGEN LLC
135 E Dania Beach Blvd, Apt 1, Dania Beach, FL 33004
[email protected]
2. Filing a notice of infringement
Your notice must be in writing and include:
- your physical or electronic signature as the copyright owner or a person authorized to act on the owner’s behalf;
- identification of the copyrighted work you claim is infringed;
- identification of the material you claim is infringing, with enough information for us to locate it, such as the exact URL;
- your name, address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law;
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Notices that do not include these elements may not be processed.
3. What we do after receiving a notice
When we receive a valid notice, we will remove or disable access to the material, or require our customer to do so, and notify the customer. Because our customers control the content on their servers, we may first forward the notice to the customer and give them a short time to act before we disable access ourselves.
4. Counter-notice
If you believe material was removed by mistake or misidentification, you may send a counter-notice to our designated agent that includes:
- your physical or electronic signature;
- identification of the material that was removed and where it appeared before removal;
- a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification;
- your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which PomeloHost may be found), and that you will accept service of process from the person who filed the original notice.
After receiving a valid counter-notice, we will forward it to the person who filed the original notice. We may restore the material in 10 to 14 business days unless that person informs us that they have filed a court action to restrain the activity.
5. Repeat infringers
We terminate, in appropriate circumstances, the accounts of customers who repeatedly infringe copyrights.
6. Misrepresentations
Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. If you are not sure whether material infringes your rights, consult an attorney before sending a notice.
7. Other complaints
Trademark complaints, abuse reports and other legal requests should be sent to [email protected] or [email protected].
